All products (“Products”) available for purchase online through the website www.cagi.eu (“Site”) are covered by the legal warranty of conformity provided for by Articles 128 et seq. of Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”), lasting for 24 (twenty-four) months from the delivery of the Product, provided that the purchaser is a consumer pursuant to the Consumer Code (“Consumer”).

For the purposes of these Conditions, a Consumer is defined as a natural person acting for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity they may carry out.

The Seller is liable to the Consumer for any lack of conformity that exists at the time of delivery of the Product and manifests itself within 2 (two) years from delivery.

Any action by the Consumer intended to assert defects of conformity not intentionally concealed by the Seller shall be time-barred, in any case, within a period of 26 (twenty-six) months from the delivery of the Product.

In the event of a lack of conformity, the Consumer has the right, at no cost, to have the Product brought into conformity by repair or replacement. The Consumer may choose between the two remedies, unless the chosen remedy is impossible or imposes disproportionate costs on the Seller compared to the other remedy.

In the cases provided for by the Consumer Code, the Consumer is entitled to a proportionate reduction in price or the termination of the contract. Repairs or replacements must be carried out within a reasonable period of time from the moment the Seller was informed of the lack of conformity, without expense and without significant inconvenience to the Consumer.

The legal warranty does not cover defects occurring after delivery resulting, for example, from improper use of the Product, use not in accordance with its intended purpose, or failure to follow the instructions for use and washing.

To exercise the rights arising from the legal warranty, the Consumer may contact the Seller using the contact details indicated in these General Terms and Conditions of Sale.

Should it be necessary to return the Product, the Consumer will receive the relevant instructions from the Seller.
